Anti-Discrimination 

It is the policy of the Township of Moorestown to treat the public, employees, prospective employees, appointees, volunteers and contractors in a manner consistent with all applicable civil rights laws and regulations including, but not limited to the Federal Civil Rights Act of 1964 as subsequently amended, the New Jersey Law against Discrimination, the Americans with Disabilities Act and the Conscientious Employee Protection Act, and the governing body of the Township has determined that certain procedures need to be established to accomplish this policy. Moorestown Township emphatically prohibits discrimination on the basis of race, color, or national origin, as well as other forms of discrimination such as age, handicap, marital or familial status, sexual orientation, religion, etc. All persons who observe such misbehavior are strongly encouraged to document incidents of discrimination at the time the incident occurs (or as soon as possible thereafter). Citizens are encouraged to report such incidents promptly to enable the Township to take corrective action. Citizens should record the date, time and location where the incident took place, the parties involved (including witnesses) and an account or description of what occurred, and any statements made by any person who participated in, or observed the incident. Americans with Disabilities 

Township Manager Kevin Aberant is Moorestown Township's American with Disabilities (ADA) Coordinator. His office is located in Town Hall at 111 West Second Street, Moorestown NJ 08057 where he can be reached at (856)914-3001 or via email at kaberant@moorestown.nj.us.

In accordance with the requirements of title II of the Americans with Disabilities Act of 1990 ("ADA"), the Township of Moorestown will not discriminate against qualified individuals with disabilities on the basis of disability in its services, programs, or activities. 

Employment: Township of Moorestown does not discriminate on the basis of disability in its hiring or employment practices and complies with all regulations promulgated by the U.S. Equal Employment Opportunity Commission under title I of the ADA.

Effective Communication: Township of Moorestown will generally, upon request, provide appropriate aids and services leading to effective communication for qualified persons with disabilities so they can participate equally in the Township of Moorestown’s programs, services, and activities, including qualified sign language interpreters, documents in Braille, and other ways of making information and communications accessible to people who have speech, hearing, or vision impairments.

Modifications to Policies and Procedures: Township of Moorestown will make all reasonable modifications to policies and programs to ensure that people with disabilities have an equal opportunity to enjoy all of its programs, services, and activities.

Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service, or activity of the Township of Moorestown should contact the Township’s ADA Coordinator, Kevin Aberant, Township Manager as soon as possible but no later than 48 hours before the scheduled event.

The ADA does not require the Township of Moorestown to take any action that would fundamentally alter the nature of its programs or services, or impose an undue financial or administrative burden.

Complaints that a program, service, or activity of the Township of Moorestown is not accessible to persons with disabilities should be directed to ADA Coordinator Kevin Aberant, Township Manager, 111 W. Second Street, Moorestown, NJ 08057; email: kaberant@moorestown.nj.us.

The Township of Moorestown will not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of providing auxiliary aids/services or reasonable modifications of policy.

ADA Transition Plan 

In March 2019, Moorestown Township contracted with Pennoni to perform a self-evaluation and develop transition and action plans for township facilities, programs and pedestrian accommodations within the public right-of-way (ROW). A self-evaluation is performed to identify the compliant and non-compliant physical features within the township’s facilities and practices in the township’s programs and services. The transition plan is a tool the township can utilize to document, prioritize and track the status of non-compliant facilities such as curb ramps, on-street parking, city owned and leased buildings, and park facilities. The action plan is a tool the township can utilize to document non-compliant practices such as provision of alternative media sources or sign language interpreters.

ADA Grievance Procedure

The Township of Moorestown has adopted the following grievance procedure to comply with the requirements of the ADA. It may be used by anyone who wishes to file a grievance alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits by the Township of Moorestown.

The grievance should be in writing, and provided on the form provided by the Township of Moorestown (below), if possible, and contain information, including, but not limited to, name, address, phone number, email address of complainant and location, date, time and description of the alleged discrimination. Alternative means of filing grievances, such as personal interviews or an audio recording of the grievance will be made available for persons with disabilities upon request. A grievance may be filed via the ADA Discrimination Grievance Form

The grievance should be submitted within 90 calendar days of the alleged incident, to the ADA Coordinator: Township Manager, Kevin Aberant, Moorestown Township, 111 West Second Street, Moorestown, New Jersey 08057 or kaberant@moorestown.nj.us.

Within 15 calendar days after receipt of the grievance, the ADA Coordinator will review the grievance and take appropriate steps to initiate an investigation and possible resolution. The Township will make every effort to respond within 30 days of receiving the grievance, in writing, and where appropriate, in a format that is accessible to the complainant, such as large print or audio recording. The response will explain the position of the Township of Moorestown and offer options for substantive resolution of the grievance. 

If a reasonable resolution of the grievance is not reached through this procedure, an appeal can be filed with the United States Department of Justice
